Match.com No longer top dating site, sends in the lawyers.

Here is comscores worldwide ranking of dating sites for march.    We are doing pretty good considering we are only in  UK, Canada and US.

Last year  Match launched a plentyoffish clone  called downtoearth.com  which was supposed to be a free dating site that would compete with plentyoffish.   After it failed to get any traction they shut down the service..   Now match.com is back again today with today with a legal notice that you can read here.    Match.com says its not possible that plentyoffish has as many signups as we do every day.   Match says there is no way we can generate as many relationships and dates as we do.    Match  than demands that we enter into a confidential agreement where we show them how we are able to generate more relationships  and dates than they do,  and how we got so much bigger along with a lot of other things they want to know.

This letter is beyond ironic considering match’s history of bogus claims,  like this one from last week.  Match  claims that 42% of dates from dating sites are as result of match.com and 30% of marriages are a result of match.com     What they fail to point out is that match has been around for 15 years and most of the sites listed in the survey barely existed 5 years ago.   I especially love their marriage claim,  they take  people who married 5 years ago and met online some 18 months before that.(average dating time before marriage) .    Is there any dating site in that survey other than match  that was a top 20 dating site 7 years ago ?

If we actually look at what match.com claims it gets into the absurd.   Last year they claimed 12 marriages per day.    Eharmony claims  236 marriages per day    Now a year later  match.com claims double the number of marriages as eharmony in this survey around 472 marriages per day or 994 people getting married per day.    Match  also claims that it has 20,000 signups a day on its homepage (who knows how many of those are from the US).  If we assume they get no signups outside of the US,  and they have a sky high conversion ratio of 15% and male and female signups are equal   that means 3000 people decide to pay so they can communicate with other users.   On match.com you can’t talk to a user if you don’t pay.   So does anyone actually believe that every day 944 out of 3000 new paying users of match.com will get married eventually because of who they met on match.com?   do 1 in 3 paying subscribers of match.com even go out on a date???   Last i heard only 15% or so of relationships lead to marriage. 

I am going to focus on my wedding reception this weekend,  and not threats from match.com

    Someone failed to tell the Dallas lawyer in the USA that PoF is based in CANADA. What’s he going to do? File a case in a place where he has no jurisdiction? The case has no bearing, anyway. If I were a judge, I’d throw the case out and call for the lawyer to be disbarred.

    Hmm, that sounds like the indignation/disbelief that Intuit expressed toward Mint.com about their numbers once upon a time. In that case, Patzer just talked them through the numbers and made them look rather foolish. Could be a sound approach!

I believe that you’ve got a sound case against Match.com, and I’m no fan of that kind of legal intimidation. Yet you’ve done a poor job of articulating your position, of laying out the facts of your perspective or describing what conclusions we readers should draw. This post is pretty inscrutable.

    Obviously this isn’t a business-critical function or anything, but if you care about expressing ideas, you should care about expressing them clearly.

    It seems that, as is often the case, there is a lot of people missing the point.

    Has Match.com really got the legal right to demand proof of your claims? In most of the legal dealings I have had, it has fallen to a third party ombudsman to substantiate claims – meaning no party gains sensitive information through covert methods (I’m sure your solicitors can advise).

    It is obvious what end they are attempting to achieve, but by simply changing the wording of some of the claims to “we expect” or “it is our belief that” – you avoid any legal implications whatsoever (it’s entirely your right to expect or believe whatever you wish ;) lol)

    Hope you get a good outcome as I’m a great supporter of free sites – I believe you’ve already got some good advertising out of this sillyness ;)

    Markus, from my vantage, maybe just a smokescreen. Match.com’s real intent appears to be to buy PoF, but they want access to and confidence in your numbers being legitimate in order to do a valuation to make sure they don’t overpay.

    Markus, this is most likely an early wedding gift. If you look at Intuit (Quickbooks, Quicken) they did the exact same thing to Mint.com, only to find that mint.com was as big as it claimed (trending bigger) and subsequently Intuit paid $170mm for Mint.com

    So the real question is, how much is Match.com going to have to cough up in cash for POF?

Obviously you use “stealth” marketing tactics (“guerrilla-like”, “The Art of war – like”, “low” profile, brand-building, viral, inflated numbers) so as I see it, both of you (match,pof) are using similar tactics, for example you use this blog in a strategic way too…. like disclosing this info… mutual research and attacks…. so let’s not be hypocrital please.     First off congrats with your wedding. I understand you have been together with your girlfriend even before POF was created. Again congratulations and I wish the best for both of you.

    Okay…. now I need to break down the facts. It is true that you charge members to become a “Serious Member”. Now it does not take a rocket scientist to figure out that when you claim it is “100 % Free Dating Site” yet you charge people money to have a amber colored background in the users profile is probably the most ridiculous idea you had come up with to date.

    I also want to make a claim too… the planet is actually flat and not round. Now where do I get the data to support those facts? I do not have them. NO SUPPORTING DATA – DO NOT PUT SUCH CLAIMS ON YOUR SITE. Just by Match.com bringing this to your attention and you not taking accountability of these bogus claims shows me lack of credibility on your part.

    Sorry to say this buddy and not to stress you out since you are getting married and all but you are going to lose in a court of law. You provide claims without any data to support it. My marketing professor once told me “If you do not have the data to support your claim then do not even mention it. If you do then be prepared to present your case. If not you will get a big “F”.”

    The fact you charge users to be “Serious Members” when the site is suppose to be 100% completely free and also have misleading info… I would not be surprised if you have a class action lawsuit against you from your active online users.

    Your claim to it being COMPLETELY 100% FREE IS NOT TRUE.

    I am not here to judge anyone and from what I have seen you seem like a nice guy. Truth is Markus you have mislead people with this data and for that very reason I would spend some of the millions you earned and get yourself a good lawyer. Truth of the matter is once your lawyer sees the case he will settle out of court which I think match.com will plan to end your rein as leading dating site on the net.

    And who cares if POF is the biggest dating site! It’s not hard to make a dating site especially as ugly and not user friendly as POF. It is also not hard to not charge for something. He is only big because it’s free and he was one of the first to think of giving it away for free.

    Brilliant business plan lets give it away for free and promote competitors that have a REAL business going. Yes he has made a lot of money and still does but only because he was the first to do something soooooooo simple.

    His claim of 100% Free may still very well be valid, even though he charges for “serious member” status. All features of the website, are usable by all members. Any member can contact any other member, paid or not. The only thing the paid members get is that serious badge as a means of signaling their serious intent to others. They get no added usage privileges within the websites services beyond what free members get. So you can still find a date 100% for free, or you can pay to signal to others that you may be more serious about it than some of the free members.

      Hey Maple Syrup. I’m going through that lifetime membership battle with match right now. I beta tested the ancient system for months and was provided with a charter lifetime member ship. Then they started limiting my account and I would have to email. They would eventually get around to fixing things. Then the cycle would repeat in a few weeks and then to a few days. Then they finally blocked me for accessing anything after I log in. If you can’t trust match to keep their end of the deal up then why would anyone believe their statistics? They sure aren’t going to win any cheerleaders acting like jerks.
